Acceptance of Terms
By accessing or using www.aboveconsulting.com.hk (the “Website”), engaging with Above Consulting Hong Kong Limited (“we,” “us,” “our”), or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Website or our services.
1. Use of Website
You may use the Website for lawful purposes only. You agree not to:
• Engage in unauthorized data collection or scraping
• Interfere with Website functionality
• Impersonate any person or entity
• Upload malicious code or viruses
2. Intellectual Property
All content on the Website, including text, graphics, logos, and the GAIN Framework name, is owned by us or licensed to us and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written consent.
3. Services & Growth-as-a-Service (GaaS)
Our consulting services, including the GAIN Framework and GaaS model, are provided on a subscription or project basis. All engagements are subject to separate agreements. We reserve the right to refuse service to anyone.
4. Client Responsibilities
To ensure successful collaboration, you agree to:
• Provide accurate and complete information for all engagements.
• Actively cooperate during project execution.
• Make timely payments as per agreed terms.
• Maintain confidentiality of proprietary materials shared.
5. Payment Terms
Fees are due upon invoice. Late payments incur a 3% monthly interest. We accept bank transfer and credit card. All fees are non-refundable unless otherwise stated.
6. Confidentiality
Both parties agree to keep confidential all non-public information received during the engagement. This obligation survives termination.
7. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid in the preceding 12 months.
8. Termination
We may terminate or suspend access to our services immediately, without prior notice, for any breach of these Terms. Upon termination, all unpaid fees become due.
9. Governing Law
These Terms are governed by the laws of Hong Kong SAR. Any disputes shall be resolved in Hong Kong courts.
10. Changes to Terms
We may update these Terms at any time. Changes will be posted here with the updated date. Continued use constitutes acceptance.
